Machholz Estate Court Case

It all began in July of 16

Dad got sick and Mom hit a tree

Then Dad fell down and broke some bones

They were both in chairs and needed a new home

 

My siblings said we can’t be bothered

Mom’s OK but we can’t handle father

My wife and I said you can stay with us

We will make it work, we love you so much

 

My sister called authorities she thought we were stealing

We weren’t but that did not stop her from having that feeling

Mom said we’ll show her and remove her from the Will

No one said anything, we all sat there still

 

Mom passed away on a very sad day

Then my brother demanded financials, concerned about his take away

My Dad said no, it’s none of your business

I’m still alive, love it here and you are being vicious

 

My brother texted me about the attorney he hired

Would pilfer from my Dad the information he desired

My brother visited us and refused to discuss it

Was he waiting for Dad to just kick the bucket?

 

A week later Dad announced his decision

I want to make a Will revision

He said he will give everything to me

“Those siblings of yours just want my money”

 

So get me a lawyer and I will make it legal

I’ll disinherit them, they will say it is not equal

The lawyer said let’s wait until after you pass

Then we will tell them, it will knock them on their ass

 

A year went by as Dad notarized all papers

He gave people money and some land to his neighbor

He said he wished he could see the look on their faces

When they realized they had gambled and lost their oasis

 

Then my dad died at very old age

My two siblings learned they had been thrown offstage

The things they had done carried consequences

They refused to accept, but they were defenseless

 

So they decided to sue us with some lengthly allegations

And their lies began with character assassinations

We had to hire an attorney with gumption

They harassed and threatened with court injunction

 

They said we applied undue pressure and abuse

That we bullied Dad and dangled the noose

When actually we were silent caregivers day and night

Watching the siblings drama and abuse take flight

 

They said our nineteen witnesses were not enough

Health care workers, notaries, church friends they all rebuffed

Worst of all were their conspiracy theories

My siblings care nothing for my Dad’s legal decision

They discredited his intention, his life, his vision

They showed who they are by their selfish actions

They destroyed the family, shattered into factions

 

This continued for a year and times were hard

I got cancer, fixed it and avoided the grave yard

We decided to settle and end the whole episode

We’ll get on with our life and let them have the low road

 

So we gave them an RV and some property too

Some cash and goodbye and hey, screw you

We move on with what’s left and we make the best

We passed the stress test without cardiac arrest

 

This whole episode cost us a half million dollars

High blood pressure and hundreds of hours

A lesson learned is to never have siblings

Or if you do may they be normal from the very beginning

 

The views are great from where we reside

The kittens love us and our truck is a great ride

Starting over isn’t bad when we are in this together

Batten down the hatches and weather the weather forever

MACHHOLZ ESTATE CASE STATUS

Robert Machholz and Carol Hasenick have filed a lawsuit against Dad’s estate attorney utilizing my name instead of theirs.

Instead of utilizing their own names in their new lawsuit they are attempting to show that my wife and I suffered a loss through the actions of dad’s estate attorney.

The use of my name in their lawsuit is without my permission.

They are attempting to squeeze money out of the dad’s attorney’s insurance company.

We don’t support their lawsuit and find it appalling that they can utilize my name in Placer County Superior Court in Roseville, California, with an attorney I’ve never spoken with listed on the complaint.

Our Executed Settlement Agreement – Machholz

Donald Edward Machholz, Sr., 95, of Concord, California passed away on January 28, 2018, in Auburn, California. He was born on October 25, 1922, in Buffalo, New York to Edward and Loie Machholz. Donald grew up in San Diego, California, and is a 1940 graduate from Hoover Senior High in San Diego. He served in the United States Navy for 30 years from 1942 through 1972, was honorably discharged and retired as a Lieutenant (LTJG) from the Naval Station on Treasure Island, San Francisco. During his service, he was awarded three Bronze Stars for the World War II Victory Medal, the National Defense Service Medal, and the Vietnam Service Medal. Excerpted from a letter written on October 25, 1942 from Donald’s mother, “When you were only two or three years old I would look at you and wonder just what you would do when you got older and I can truly say that not once did I see you in Navy Blue. Sometimes it is hard to believe but you look swell in them and no Mother is prouder of her Son than I am of you.” Donald married Doris Louise Machholz in 1949 in Buffalo, New York. They were happily married for 67 years and raised four children together. Despite dividing his time between the Navy and family he was a good father and provider. He loved his family and friends. For over 50 years Donald was a member at the First Lutheran Church in Concord, California serving at different times as an elder, an usher, a layman, a Sunday School teacher and Superintendent. Donald is preceded in death by his wife, Doris Machholz, 2016, and son, David Paul Machholz, 1976. Donald is survived by his daughter Carol (Hasenick) Machholz and husband Robert of Santa Rosa, California, his son Donald Machholz, Jr. and wife Michele, of Colfax, California, his son Robert Machholz and wife Jeanette of North Bend, Washington. A memorial service will be held at the First Lutheran Church, 4000 Concord Boulevard, Concord, California at 10:00 am, Saturday, February 10, 2018. Burial will be at the Sacramento Valley National Cemetery.
